Domestic Violence

Domestic Violence cases are among the most defensible cases. Typically the alleged victim is the only witness for the prosecution. Much can be done in advance of trial to undermine the victim's testimony.

DUI/DWI

Driving under the influence may be the most common crime committed by ordinary Americans since the 1980s legislatures and courts have been increasing the severity of punishment for DUI and DWI crimes. Thanks to the Lobbying efforts of groups like Mothers Against Drunk Driving (MADD) DUI has gone from being little more than a traffic offense to a serious crime and a predicate offense.

Assault

Assault cases are among the most defensible of criminal cases. Almost always, there is the defense of self defense. Also, unlike many other kinds of cases, the facts of what actually happened are most in dispute. If you have been charged with an assault crime, gathering evidence in advance of trial may be the most important thing that you can do.

Gun Crimes

Until recently, Oklahoma had the toughest drug laws in the nation! When Oklahoma eliminated those laws, the number of criminal prosecutions were cut roughly in half. Nature abhors a vacuum. Prosecutors must put people in prison if they are to advance up the ranks in the prosecutor’s office. Consequently, whereas felon in possession of a firearm cases used to be probation cases they are now often prison cases. Typically, just as in drug cases, , there are only two defenses. One is legal, the other is factual.

Personal Injury

Frequently, lawyers take too much of their client's personal injury settlements. A well-constructed demand letter can put more money in the defendant's pocket than can litigation with its attendant costs.

The reality is that 94% of state law criminal cases result in plea bargains. When most lawyers are trying to get hired they talk about “Fight, Fight, Fight.” The problem with that is that it is hard to make friends and negotiate good outcomes while fighting. More importantly, it is impossible for a lawyer to simultaneously convince you that he will beat your case while also convincing you to do the things that will make your case better if he doesn’t beat your case.  Six months into your case is too late to begin doing the things that will result in the best outcome for you case. I frequently tell people that even if they don’t hire me, they need to do the things I tell them to do at the beginning of the case because there is a 94% case that they will ultimately become part of the 94%.
